Terms of Service

These Terms of Service (“Terms”) are a legally binding agreement between you and Tunelist LLC, doing business as Tunelist (“Tunelist,” “we,” “us,” or “our”).
1. Agreement to these terms
These Terms govern your access to and use of tunelist.online and all related websites, applications, features, services, and marketplace functionality that we operate (collectively, the “Service”).
By creating an account, accessing or using the Service, purchasing Tokens, submitting music, listing a playlist, or otherwise using the Service, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
2. What Tunelist is
Tunelist is a marketplace that facilitates submissions of music by artists to independent playlist curators for human listening and editorial consideration. A submission is an opportunity for a curator to listen to and independently evaluate a song according to the curator's own editorial standards.
Tunelist does not sell, promise, guarantee, or represent that a submission will result in playlist placement, streams, followers, listeners, exposure, engagement, promotion, or any other particular result. A curator may accept or reject a submission in the curator's independent editorial judgment. A curator receives the same compensation for completing a valid review regardless of whether the curator accepts or rejects the submission. Any person who represents that Tunelist guarantees placement, streams, followers, or another particular outcome is not authorized by Tunelist to make that representation.
Tunelist is not Spotify. Tunelist is independent of Spotify and is not sponsored, endorsed, administered, or affiliated with Spotify.
3. Spotify and third-party services
The Service may use information made available through Spotify or other third-party services. Spotify is a separate service governed by its own terms and policies. Your use of Spotify remains subject to Spotify's applicable terms, policies, and requirements.
Tunelist does not control Spotify and does not guarantee that Spotify will continue to make any particular API, playlist, metadata, account, or other functionality available. Tunelist may modify, suspend, or discontinue any Spotify-related feature if required by law, third-party policy, technical limitations, or changes to third-party services.
Tunelist does not access your personal Spotify account, listening history, library, or other account-linked information through Spotify OAuth unless expressly disclosed and authorized in accordance with applicable policies. Where Spotify content or metadata is displayed through the Service, Tunelist may be required to comply with Spotify's attribution, linking, branding, and other requirements.
You must not use the Service to artificially manipulate Spotify streams, followers, engagement, or other Spotify metrics.
4. Eligibility
You must be at least 18 years old to create or maintain an account. By using the Service, you represent that:
- you are at least 18;
- you have authority to enter into these Terms;
- all information you provide is accurate and current; and
- you will comply with applicable law and these Terms.
Tunelist does not knowingly permit individuals under 18 to create accounts.
5. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring under your account. You must not:
- share your account credentials;
- impersonate another person;
- create an account using false information;
- create multiple accounts to evade restrictions;
- access another user's account;
- allow another person to use your account to circumvent platform restrictions; or
- otherwise interfere with the security of the Service.
Notify Tunelist promptly if you believe your account has been compromised.
6. Tokens
Tunelist may use prepaid credits called “Tokens” to facilitate submissions. Tokens:
- are prepaid platform credits;
- may only be used through the Service;
- have no cash value;
- are not currency, deposits, securities, or an ownership interest in Tunelist;
- are not transferable between accounts unless Tunelist expressly permits transfer;
- may not be redeemed for cash except where required by law or expressly provided under these Terms; and
- may not be sold, exchanged, or traded outside the Service.
The price of Tokens is displayed at the time of purchase and may change prospectively. The price applicable to a submission is the Token price displayed when the submission is made. A change in future pricing does not retroactively change the price of a completed transaction. Promotional or complimentary Tokens may be subject to additional restrictions disclosed when issued.
7. Purchases and payments
Token purchases are processed through third-party payment providers, including Stripe. Tunelist does not store your full payment card number or full bank account information where those payment details are collected directly by the payment processor.
You authorize the applicable payment processor to charge your selected payment method for purchases you initiate. You are responsible for providing accurate billing information and maintaining a valid payment method. Taxes, where applicable, may be added to purchases.
8. Submissions
When you submit a song for review:
- the applicable Token amount is deducted;
- the submission is assigned to a qualifying curator or otherwise processed through the marketplace;
- the curator is given the applicable review period displayed by the Service; and
- the curator may accept or reject the submission according to the curator's independent editorial judgment.
The review period displayed in the Service at the time of submission controls that particular submission. Tunelist may establish different review periods for different submissions, playlists, or marketplace configurations.
9. Review completion and refunds
A curator must complete a genuine, good-faith listen and make an independent editorial decision within the applicable review period. If the curator does not complete the required review within the applicable period, the submission will ordinarily be canceled and the Tokens used for that submission will be returned.
A review is considered completed when the curator submits the required decision through the Service in accordance with the applicable marketplace requirements. A curator does not earn compensation merely by clicking a decision button if Tunelist determines, in good faith, that the submission was not genuinely reviewed or was otherwise manipulated.
Completed and valid reviews are generally final and are not refundable solely because the artist disagrees with the curator's decision. If you believe a review was fraudulent, incomplete, improperly processed, or otherwise violated these Terms, contact hello@tunelist.online.
10. No guaranteed outcome
You acknowledge that:
- a curator may reject your song;
- a curator may accept your song;
- an acceptance does not guarantee that your song will remain on a playlist;
- playlist placement may later change;
- Spotify may change or remove playlist functionality;
- a playlist may gain or lose followers;
- follower counts do not represent guaranteed listeners or streams; and
- Tunelist cannot guarantee any commercial, promotional, audience, or streaming result.
Spotify follower counts displayed by Tunelist are follower counts and are not representations of monthly listeners, streams, reach, or engagement.
11. Artist responsibilities
You represent and warrant that you own or control all rights necessary to submit each song and any associated material through the Service. You must not submit:
- music you do not have the right to submit;
- copyrighted material without authorization;
- stolen or unlawfully obtained material;
- material that infringes another person's rights;
- malicious software;
- unlawful material; or
- material whose submission would violate applicable law or third-party terms.
You must not use multiple accounts, repeated submissions, bots, scripts, or other mechanisms to manipulate the marketplace.
12. Curator responsibilities
Curators are subject to the separate Creator Agreement, which is incorporated into these Terms with respect to curator activities. Curators must:
- genuinely own or control the playlists they list;
- provide accurate playlist information;
- maintain accurate follower and profile information;
- genuinely listen to submissions;
- exercise independent editorial judgment;
- make decisions within the applicable review period;
- accept or reject submissions without regard to whether the decision increases or decreases their compensation;
- comply with applicable law and third-party platform requirements; and
- comply with the Creator Agreement.
13. Prohibited conduct
You may not:
- create or operate fake playlists;
- falsely represent playlist ownership;
- falsify follower counts or other marketplace information;
- buy, sell, or exchange guaranteed playlist placement through Tunelist or outside the Service;
- solicit or accept off-platform payment for a guaranteed acceptance, placement, promotion, or special treatment;
- use bots, scripts, automation, scraping, or other mechanisms to manipulate submissions, reviews, Tokens, rankings, or marketplace activity;
- create multiple accounts to evade restrictions or manipulate the marketplace;
- submit content you do not have rights to submit;
- interfere with another user's account;
- attempt to access non-public information without authorization;
- reverse engineer or circumvent security controls;
- use the Service to artificially manipulate Spotify plays, followers, engagement, or other metrics;
- misrepresent an affiliation with Tunelist or Spotify;
- use the Service for unlawful activity;
- use the Service to harass, threaten, defraud, or deceive another user; or
- otherwise interfere with the operation or integrity of the Service.
14. Intellectual property
Except for content submitted by users, Tunelist and its licensors own all rights in the Service, including its software, design, branding, trademarks, logos, databases, interfaces, features, documentation, and other proprietary materials. You retain ownership of the music and other content you submit.
By submitting content to Tunelist, you grant Tunelist a limited, non-exclusive, worldwide, royalty-free license to host, reproduce, display, transmit, process, and make the content available to the extent reasonably necessary to:
- operate the marketplace;
- provide the requested review;
- facilitate communications between artists and curators;
- administer disputes;
- enforce these Terms;
- prevent fraud and abuse; and
- maintain records required for legal, security, accounting, or operational purposes.
This license ends when the content is deleted, except to the extent the content must reasonably be retained for legal, security, fraud-prevention, dispute-resolution, or backup purposes.
You also grant Tunelist the right to display your name, artist name, playlist name, profile information, and other marketplace information that you intentionally make public through the Service for purposes of operating and promoting the marketplace. Tunelist does not acquire ownership of your music merely because you submit it.
15. Feedback
If you voluntarily provide suggestions, ideas, feature requests, or other feedback about Tunelist, you grant Tunelist a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without compensation or attribution. This provision does not transfer ownership of your music or other copyrighted creative works.
16. Copyright complaints
Tunelist respects intellectual property rights. If you believe content available through the Service infringes your copyright, you may submit a copyright complaint using the procedure described on our Copyright & DMCA page.
Tunelist may remove or restrict access to content that it reasonably believes infringes rights or violates these Terms. Tunelist may terminate accounts of repeat infringers where appropriate.
17. Trust, safety, and marketplace integrity
Tunelist may monitor marketplace activity for fraud, abuse, manipulation, ownership discrepancies, automated activity, suspicious review behavior, off-platform payment requests, and other conduct that threatens marketplace integrity. Tunelist may investigate reports and may take action including:
- requesting additional information;
- limiting account functionality;
- suspending playlists;
- suspending accounts;
- canceling submissions;
- reversing or withholding payouts associated with fraudulent activity;
- returning Tokens;
- removing marketplace listings; or
- terminating accounts.
Tunelist does not guarantee that every fraudulent or abusive activity will be detected.
18. Suspension and termination
You may stop using the Service and close your account at any time. Tunelist may suspend or terminate an account where reasonably necessary, including for:
- violation of these Terms;
- violation of the Creator Agreement;
- fraud;
- abuse;
- infringement;
- marketplace manipulation;
- security threats;
- unlawful activity;
- payment disputes or fraud;
- violation of third-party platform policies; or
- protection of Tunelist, its users, or third parties.
Tunelist may take immediate action when necessary to prevent ongoing harm or abuse. Where appropriate, Tunelist may provide notice and an opportunity to respond before taking action.
If an account is terminated for fraud, abuse, manipulation, or another material violation, Tokens or pending earnings associated with the violating conduct may be withheld or forfeited to the extent permitted by law. Termination does not eliminate obligations that by their nature should survive termination.
19. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TUNELIST DOES NOT WARRANT THAT:
- THE SERVICE WILL ALWAYS BE AVAILABLE;
- THE SERVICE WILL BE ERROR-FREE;
- A PLAYLIST WILL ACCEPT A SUBMISSION;
- A SONG WILL RECEIVE PLACEMENT;
- A PLAYLIST WILL PRODUCE STREAMS, FOLLOWERS, LISTENERS, OR ENGAGEMENT;
- ANY PARTICULAR CURATOR WILL REMAIN ACTIVE;
- ANY THIRD-PARTY SERVICE WILL REMAIN AVAILABLE; OR
- THE SERVICE WILL PRODUCE ANY PARTICULAR COMMERCIAL RESULT.
TUNELIST IS NOT RESPONSIBLE FOR A CURATOR’S INDEPENDENT EDITORIAL DECISION. TUNELIST DOES NOT CONTROL SPOTIFY OR OTHER THIRD-PARTY SERVICES AND IS NOT RESPONSIBLE FOR THEIR ACTIONS, POLICIES, AVAILABILITY, CHANGES, OR TERMINATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY WARRANTY NOT EXPRESSLY PROVIDED IN THESE TERMS IS DISCLAIMED.
20. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNELIST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, STREAMS, FOLLOWERS, LISTENERS, DATA, GOODWILL, OR REPUTATION ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNELIST’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID TO TUNELIST DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- $100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
21. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Tunelist and its officers, directors, employees, agents, affiliates, contractors, and licensors from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:
- your use of the Service;
- your violation of these Terms;
- your violation of applicable law;
- your violation of another person's rights;
- content you submit;
- your failure to obtain necessary rights or permissions;
- your misuse of Spotify or another third-party service;
- fraudulent or deceptive activity conducted through your account; or
- your breach of any representation or warranty in these Terms.
Tunelist may assume exclusive control of the defense of a claim subject to indemnification, and you agree to cooperate reasonably.
22. Dispute resolution and arbitration
Before initiating formal proceedings, you and Tunelist agree to attempt in good faith to resolve any dispute by contacting the other party and providing a written description of the dispute. You may contact Tunelist at hello@tunelist.online.
If the dispute is not resolved within 30 days after notice, the dispute will be resolved through individual arbitration to the extent permitted by applicable law. The arbitration will be administered by JAMS under its applicable consumer arbitration rules, unless the parties agree otherwise. The arbitration will take place in the county where you reside unless applicable law requires another location or the parties agree otherwise.
You and Tunelist agree that arbitration will occur only on an individual basis and not as a class, collective, consolidated, or representative action, except to the extent such waiver is prohibited by law.
Nothing in this section prevents either party from:
- bringing an eligible claim in small claims court;
- seeking temporary or preliminary injunctive relief where legally available;
- reporting conduct to a government agency; or
- exercising rights that cannot legally be waived.
Arbitration opt-out. You may opt out of this arbitration provision by sending written notice to hello@tunelist.online within 30 days after first accepting these Terms. Your notice must identify your name, account email address, and a clear statement that you are opting out of arbitration.
23. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law or mandatory consumer protection laws provide otherwise.
24. Changes to these terms
Tunelist may update these Terms as the Service evolves. If we make material changes, we will provide notice through the Service or another reasonable method. The updated Terms will become effective on the date stated in the updated Terms. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms to the extent permitted by law.
25. Electronic communications
You consent to receive electronic communications from Tunelist regarding your account, transactions, submissions, reviews, payouts, security, legal notices, and other Service-related matters. Electronic notices satisfy any legal requirement that such communications be in writing to the extent permitted by law.
26. Miscellaneous
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Tunelist’s failure to enforce a provision does not waive its right to enforce that provision later.
You may not assign your rights or obligations under these Terms without Tunelist’s prior written consent. Tunelist may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or similar transaction.
These Terms, together with documents incorporated by reference, constitute the entire agreement between you and Tunelist concerning the Service.
