Creator Agreement

This Creator Agreement (“Agreement”) applies to users who list playlists or perform curator activities through Tunelist. By applying to become a curator, listing a playlist, or accepting submissions through Tunelist, you agree to this Agreement and the Tunelist Terms of Service.
1. Independent curator
You provide editorial review services independently through the Tunelist marketplace. Nothing in this Agreement creates an employment relationship, partnership, joint venture, agency relationship, or other relationship except as expressly required by applicable law. You are responsible for your own taxes and legal obligations arising from amounts you receive through Tunelist.
Nothing in this Agreement guarantees that you will be legally classified as an independent contractor under every applicable law. Worker classification is determined under applicable law based on the actual relationship and circumstances.
2. Playlist verification
To list a playlist, you must provide information sufficient for Tunelist to verify that you genuinely control or operate the playlist. Tunelist may request:
- playlist URL;
- Spotify profile information;
- screenshots;
- additional ownership information;
- information concerning playlist activity; or
- other reasonable verification materials.
Tunelist may approve, reject, or request additional information. Tunelist may suspend or remove a playlist if ownership can no longer be reasonably verified or if information appears inaccurate.
3. Accurate information
You must keep your marketplace information accurate. You may not misrepresent:
- playlist ownership;
- follower counts;
- genre;
- playlist activity;
- editorial focus;
- playlist availability; or
- your relationship with Spotify or Tunelist.
4. Review obligation
When a submission is assigned to you, you must genuinely listen to the submitted song and make an independent editorial decision. You must complete the review within the deadline displayed in your Tunelist dashboard for that submission. The dashboard deadline applicable at the time of the submission controls.
A review must not be:
- automated;
- randomly generated;
- based solely on metadata;
- completed without genuine consideration of the song; or
- manipulated for the purpose of generating payouts.
5. Accept and reject compensation
You will receive the same applicable compensation for a valid completed review regardless of whether you accept or reject the submission. Your compensation is not increased, decreased, conditioned, or otherwise determined by the outcome of your editorial decision.
You must not request, accept, or solicit additional compensation from an artist in exchange for:
- acceptance;
- playlist placement;
- higher placement;
- special treatment;
- faster review; or
- another favorable editorial outcome.
6. Missed reviews
If you do not complete a valid review within the applicable review period:
- the submission may be canceled;
- the artist’s Tokens may be returned; and
- you will not receive compensation for that submission.
7. Payouts
Completed-review earnings become eligible for payout after the applicable holding period displayed in the Tunelist dashboard. Tunelist may use a holding period to account for refunds, disputes, fraud reviews, and payment reversals.
Payouts are processed through Stripe Connect or another designated payment provider. You are responsible for completing any required identity, tax, and payout verification. Tunelist may delay payouts while required verification remains incomplete.
8. Fraudulent activity
Tunelist may withhold, reverse, or cancel pending earnings associated with fraudulent, manipulated, or invalid activity, to the extent permitted by law. Examples include:
- fake reviews;
- automated reviews;
- fake playlist ownership;
- manipulated follower information;
- multiple accounts used to circumvent restrictions;
- off-platform payment arrangements;
- coordinated submission manipulation; or
- other conduct intended to improperly generate payouts.
Where appropriate, Tunelist may notify you and provide an opportunity to respond. Immediate action may be taken when necessary to protect the marketplace or users.
9. No guaranteed volume
Listing a playlist does not guarantee:
- any minimum number of submissions;
- any minimum earnings;
- any particular artist demand;
- continued marketplace visibility; or
- continued availability of the Service.
Submission volume may depend on artist demand, pricing, genre, playlist characteristics, marketplace activity, and other factors.
10. Off-platform transactions
You may not use Tunelist to solicit or arrange off-platform payments in exchange for:
- guaranteed acceptance;
- guaranteed playlist placement;
- preferential placement;
- special treatment;
- additional review services; or
- another outcome that undermines the marketplace.
11. Spotify compliance
You must comply with applicable Spotify terms and policies. You may not use Tunelist to artificially manipulate Spotify plays, followers, engagement, or other Spotify metrics.
You must not represent that Tunelist or Spotify guarantees a particular result. You must not represent that you are sponsored, endorsed, or affiliated with Spotify unless you actually have such authorization.
12. Reviews and editorial independence
Your decision must reflect your genuine editorial judgment. You are not required to accept a submission because an artist paid a Token fee. You are not required to reject a submission because it was submitted through Tunelist. Your compensation does not depend on the sentiment of your decision. You must not coordinate with artists to manipulate the appearance of independent editorial judgment.
13. Termination
You may stop curating and remove your playlists at any time. Tunelist may suspend or terminate your curator privileges for violations of this Agreement, the Terms of Service, applicable law, third-party policies, or marketplace integrity requirements.
Earnings that were validly earned and eligible for payout before termination will ordinarily remain payable, except to the extent associated with fraud, abuse, invalid activity, payment reversal, or another lawful basis for withholding.
14. Taxes
You are responsible for determining and paying taxes arising from your earnings. Where required, Tunelist or its payment provider may collect tax information and issue applicable tax forms.
15. Agreement changes
Tunelist may update this Agreement as the marketplace evolves. Material changes will be communicated through the Service or another reasonable method where required. Continued curator activity after the effective date of an updated Agreement constitutes acceptance to the extent permitted by law.
